OVERVIEW

Welcome to Elevation PerTech. These Terms of Service (“Terms”) govern your access to and use of elevationpertech.com, our online store, and the products, information, content, features, and services made available through them (collectively, the “Services”).

The terms “Elevation PerTech,” “we,” “us,” and “our” refer to Elevation PerTech LLC, doing business as Elevation PerTech. Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.

Please read these Terms carefully. They contain important information about orders, vehicle compatibility, installation responsibilities, warranty disclaimers, and limitations of liability. By accessing or using the Services or placing an order, you agree to these Terms and to the policies incorporated by reference, including our Privacy Policy and Refund Policy. If you do not agree, do not use the Services.

SECTION 1 – ELIGIBILITY, ACCESS, AND ACCOUNTS

You must be at least the age of majority in your state, province, or country of residence to make a purchase through the Services. If you permit a minor to use the Services on a device you own or control, you are responsible for that use.

You agree to provide current, complete, and accurate account, billing, payment, and shipping information. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.

SECTION 2 – PRODUCT INFORMATION AND AVAILABILITY

We make reasonable efforts to describe and display our products accurately. Product images, colors, surface finish, layer lines, carbon-fiber pattern, texture, and other visual details may vary because of lighting, screen settings, manufacturing processes, material batches, and normal production tolerances. These differences are not necessarily defects.

Dimensions, weights, specifications, included components, and compatibility information are approximate unless expressly stated otherwise. Product descriptions and availability may be updated without notice. We may discontinue a product or limit quantities by person, household, order, geographic region, or jurisdiction.

We do not guarantee that a product will meet a particular customer preference or work with a vehicle, engine, transmission, ECU, wiring configuration, tune, aftermarket component, or modification unless that exact application is expressly identified as compatible in the applicable product description.

SECTION 3 – VEHICLE COMPATIBILITY AND CUSTOMER RESPONSIBILITIES

Our products may be designed for modified vehicles, engine swaps, custom wiring, aftermarket components, or specific combinations of vehicle, engine, transmission, ECU, and related hardware. Vehicle modifications, prior repairs, wiring changes, software or calibration changes, manufacturing differences, and other aftermarket parts may affect fitment and operation.

Before purchasing and installing a product, you are responsible for:

1. Reviewing the complete product description, compatibility requirements, included and excluded components, installation information, warnings, and product-specific disclosures;
2. Confirming your vehicle, engine, transmission, ECU, wiring, and other relevant components match the stated application;
3. Inspecting the product before installation; and
4. Obtaining any additional hardware, tools, tuning, calibration, fabrication, or professional services identified as required or reasonably necessary for your application.

Contact us before ordering if you are unsure about compatibility. Information we provide in response to a compatibility question is based on the information you give us and does not guarantee compatibility if that information is incomplete or inaccurate or if the vehicle differs from the stated configuration.

SECTION 4 – INSTALLATION, OPERATION, AND SAFETY

Automotive parts and electronic modules must be installed, wired, configured, and used correctly. Unless a product is expressly described as suitable for customer installation without specialized knowledge, installation should be performed or inspected by a qualified automotive professional familiar with the applicable vehicle, electrical system, CAN bus, engine swap, or modification.

Before installation, disconnect power when appropriate and follow applicable service information, safety procedures, torque specifications, electrical protection requirements, and product instructions. Do not install or use a product that appears damaged, incorrectly supplied, or incompatible.

Improper wiring, incorrect polarity, short circuits, inadequate fusing, water intrusion, excessive heat, impact, modification, misuse, or installation on an unsupported application can damage the product, vehicle, ECU, wiring, sensors, or other components and may create a risk of injury, fire, loss of vehicle control, or property damage.

You are responsible for safely testing the vehicle after installation and before street or competitive operation. Stop using the product and vehicle if warning lights, communication faults, abnormal operation, overheating, smoke, electrical odor, loss of vehicle function, or another unsafe condition occurs.

No product is represented as a substitute for required factory safety systems, inspections, maintenance, professional diagnosis, or compliance testing.

SECTION 5 – EMISSIONS, OFF-ROAD, AND LEGAL COMPLIANCE

Some products may be intended for competition, racing, research, development, testing, show, or off-highway applications. Any such restriction will be stated in the applicable product description.

A statement that a product is intended for off-road or competition use does not authorize its installation or use in violation of any law. You are responsible for determining whether the purchase, installation, configuration, and use of a product is lawful in your location and application, including compliance with emissions, anti-tampering, vehicle safety, registration, inspection, noise, and highway-use requirements.

Unless the applicable product listing expressly states otherwise and identifies the relevant approval or exemption, Elevation PerTech does not represent that a product has been approved by the California Air Resources Board, the United States Environmental Protection Agency, or another regulatory authority, or that it is legal for use on a pollution-controlled vehicle operated on public roads.

You may not purchase, install, configure, or use a product for an unlawful purpose or ask us to assist in defeating, bypassing, or concealing required emissions or safety equipment.

SECTION 6 – ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt of your order but does not necessarily constitute acceptance. We may accept, decline, or cancel an order for legitimate reasons, including product unavailability, suspected fraud, payment or pricing errors, quantity limits, inability to ship to the destination, legal or regulatory restrictions, or an unsupported application identified before fulfillment.

If we decline or cancel an order after payment, we will refund the amount charged for the canceled item or order to the original payment method, except where otherwise permitted by law, such as a valid adjustment for an item already fulfilled.

Review your order carefully before submitting it. We may be unable to change or cancel an order after processing or fulfillment begins. Cancellation and return eligibility are governed by our Refund Policy.

We may contact you to verify order information, compatibility, or intended application. Failure to respond may delay fulfillment or result in cancellation and refund.

Unless we agree otherwise in writing, purchases through the retail store are not authorized for resale, redistribution, or export by a commercial reseller. Contact us for written approval and separate wholesale or distributor terms.

SECTION 7 – PRICES, FEES, TAXES, AND PAYMENT

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of an obvious pricing or listing error as described below.

Unless otherwise stated, displayed prices exclude government-imposed sales, use, value-added, customs, import, or similar taxes and exclude shipping charges. Applicable charges will be displayed during checkout when they can be calculated. You are responsible for customs duties, import taxes, brokerage fees, or other government charges imposed by the destination jurisdiction unless checkout expressly states that they are included.

You agree to provide accurate payment information and represent that you are authorized to use the selected payment method. You authorize us and our payment providers to charge the total amount shown at checkout, including applicable shipping and taxes.

Promotions may have separate terms. If promotion terms conflict with these Terms, the promotion terms control for that promotion.

SECTION 8 – ERRORS, INACCURACIES, AND OMISSIONS

The Services may occasionally contain typographical errors, inaccuracies, or omissions concerning product descriptions, compatibility, specifications, pricing, promotions, shipping charges, transit times, or availability. We may correct or update inaccurate information.

If an error materially affects an order you submitted, we may contact you for approval of the correction or cancel the affected portion and issue a refund. We will not substitute a materially different product or charge a higher price without your agreement.

SECTION 9 – SHIPPING AND DELIVERY

Processing and delivery dates are estimates unless we expressly state otherwise. Carrier transit times begin after the order is transferred to the carrier and do not include our processing time. Delays may result from order verification, product availability, carriers, weather, customs, incorrect addresses, or events beyond our reasonable control.

We will ship within the time stated in the applicable product or shipping information or, when no time is stated, within the period required by applicable law. If we cannot ship within the required period, we will provide any delay notice, cancellation option, or refund required by law.

You are responsible for providing a complete and accurate deliverable address. Additional costs caused by an incorrect or incomplete address, refused delivery, or unclaimed package may be deducted from a refund or charged for reshipment to the extent permitted by law and disclosed in our Refund or Shipping Policy.

Title and risk of loss pass as provided by applicable law. If a package is lost, damaged, missing items, or marked delivered but not received, contact us promptly so we can review the matter and, where appropriate, assist with a carrier claim. Keep the product, packaging, shipping label, and photographs of any damage. Nothing in this section limits rights or remedies that cannot legally be waived.

International customers are responsible for determining whether a product may lawfully be imported and used in the destination country. Customs authorities may open, delay, reject, or return a shipment. We are not responsible for customs actions outside our control, but we will handle any refund for returned merchandise in accordance with our Refund Policy and applicable law.

SECTION 10 – RETURNS, REFUNDS, AND ORDER PROBLEMS

Returns, exchanges, cancellations, damaged shipments, incorrect items, and refunds are governed by our Refund Policy, available at:

Inspect your order promptly after delivery and contact us within the time specified in the Refund Policy if an item is damaged, incorrect, incomplete, or defective. Do not install, modify, or continue using a product that may be incorrect or defective.

Nothing in these Terms or our Refund Policy limits rights or remedies that cannot be waived under applicable law.

SECTION 11 – LIMITED WARRANTIES

Any express warranty applicable to a product will be stated in the product description, included documentation, or a separate Limited Warranty published by Elevation PerTech. Warranty terms may vary by product category.

Unless an express warranty states otherwise, warranty coverage does not include damage or failure caused by incompatible or unsupported applications; incorrect installation or wiring; reverse polarity; short circuits; inadequate circuit protection; water, chemical, impact, vibration, or heat damage beyond stated specifications; accident; misuse; abuse; unauthorized alteration or repair; normal wear; cosmetic variation that does not affect function; vehicle faults; tuning or calibration; or another product or component.

Our warranty, if applicable, covers only the Elevation PerTech product identified in the warranty. It does not cover diagnosis, labor, towing, vehicle downtime, removal or installation, tuning, travel, substitute transportation, or damage to other parts unless an applicable law requires otherwise.

These exclusions do not apply to the extent prohibited by law. Nothing in these Terms eliminates implied warranties or other consumer rights that cannot legally be disclaimed or limited.

SECTION 12 – INTELLECTUAL PROPERTY

The Services and their original content—including our text, graphics, photographs, videos, logos, product names, designs, downloadable materials, and the selection and arrangement of that content—are owned by or licensed to Elevation PerTech and are protected by intellectual-property laws.

We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Services for lawful personal or internal business purposes related to evaluating or purchasing our products. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, transmit, scrape, or commercially exploit protected content without our prior written permission, except as permitted by law.

Elevation PerTech names, logos, product names, designs, and slogans are trademarks or trade dress of Elevation PerTech LLC or its licensors. Shopify’s names and marks belong to Shopify. Other names and marks belong to their respective owners.

SECTION 13 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, integrations, payment methods, applications, or other services supplied by third parties. We do not control those third-party services. Your use of them may be subject to separate terms and privacy policies.

To the extent permitted by law, optional third-party tools are provided “as is” and “as available” without our endorsement or warranty. Review the applicable third-party terms before using them. We may add, modify, or discontinue optional tools or features.

SECTION 14 – THIRD-PARTY LINKS

The Services may include links to third-party websites or content. We are not responsible for the accuracy, security, availability, or practices of third-party websites. Accessing a third-party site is at your discretion, and your dealings with a third party are between you and that party. Review the third party’s terms and policies before completing a transaction.

SECTION 15 – RELATIONSHIP WITH SHOPIFY

Elevation PerTech is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Elevation PerTech. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Elevation PerTech, including any injury, damage, or loss resulting from purchased products and services. To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Elevation PerTech.

SECTION 16 – PRIVACY

Our collection, use, and disclosure of personal information are described in our Privacy Policy:

Because Shopify hosts the Services, Shopify also collects and processes information relating to your access to and use of the Services. Information may be shared with Shopify and other service providers and may be processed in countries other than your own as described in the applicable privacy policies.

SECTION 17 – FEEDBACK, REVIEWS, AND SUBMISSIONS

If you submit a review, photograph, suggestion, idea, proposal, or other content (“Feedback”), you grant Elevation PerTech a nonexclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display that Feedback for operating, improving, and promoting our business and Services, subject to applicable privacy law.

You represent that you own or control the rights necessary to submit the Feedback, that it is accurate to the best of your knowledge, that you have disclosed any compensation or incentive associated with it, and that it does not violate law or another person’s rights.

We are not required to keep Feedback confidential, compensate you for it, or respond to it. We may moderate or remove Feedback that we reasonably believe is unlawful, misleading, abusive, obscene, infringing, malicious, or inconsistent with these Terms.

SECTION 18 – PROHIBITED USES

You may use the Services only for lawful purposes. You may not:

1. Violate any law, regulation, ordinance, or third-party right;
2. Infringe intellectual-property, privacy, publicity, or other rights;
3. Submit false, misleading, defamatory, abusive, or unlawful information;
4. Impersonate another person or misrepresent your identity or authority;
5. Upload malware or interfere with the security, availability, or operation of the Services;
6. Collect personal information about others without authorization;
7. Send spam, phishing messages, or unauthorized solicitations;
8. Circumvent access controls, robot exclusions, rate limits, or security measures;
9. Use automated systems to access or extract content in a manner that burdens, disrupts, or violates the stated restrictions of the Services; or
10. Use the Services or our products to facilitate unlawful emissions tampering, unsafe vehicle operation, fraud, or other unlawful conduct.

We may restrict or terminate access when we reasonably believe a violation has occurred.

SECTION 19 – TERMINATION

You may stop using the Services at any time. We may suspend or terminate your account or access if you violate these Terms, create security or legal risk, or misuse the Services.

Termination does not affect rights and obligations that arose before termination. Provisions that by their nature should survive—including payment obligations, intellectual property, warranty limitations, liability limitations, indemnification, dispute provisions, and privacy-related obligations—will survive.

SECTION 20 – WEBSITE DISCLAIMER

Product sales are subject to the express product descriptions, any applicable Limited Warranty, these Terms, and rights provided by law.

The website, general educational content, and online Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we do not warrant that the website will always be uninterrupted, secure, error-free, or free of harmful components, or that general informational content will be complete or suitable for your particular vehicle or project.

Except for an express product warranty and warranties that cannot legally be excluded, we disclaim implied warranties relating to the Services and products, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, to the fullest extent permitted by law. Some jurisdictions do not allow certain disclaimers, so all or part of this section may not apply to you.

Technical information provided through the Services is general information unless expressly made part of a product specification or written warranty. It is not a substitute for inspection, diagnosis, service information, or work by a qualified professional.

SECTION 21 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Elevation PerTech LLC and its members, managers, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, loss of use, loss of data, vehicle downtime, towing, substitute transportation, or replacement labor, arising from or related to the Services or a product, even if advised that such damages may occur.

To the fullest extent permitted by law, our total liability arising from or related to a particular product or order will not exceed the amount you paid to Elevation PerTech for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including where applicable liability for fraud, willful misconduct, gross negligence, or personal injury caused by negligence. Some jurisdictions do not permit certain liability limitations, so all or part of this section may not apply to you.

SECTION 22 – INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless Elevation PerTech LLC and its members, managers, employees, contractors, and agents from third-party claims, damages, judgments, liabilities, costs, and reasonable attorneys’ fees arising from your:

1. Material breach of these Terms;
2. Unlawful use of the Services or a product;
3. Installation or use of a product on an application you knew or reasonably should have known was unsupported or unlawful;
4. Unauthorized modification, resale, relabeling, or redistribution of a product; or
5. Violation of another person’s rights.

This obligation does not apply to the extent a claim was caused by Elevation PerTech’s own negligence, willful misconduct, breach of warranty, or violation of law. We will provide reasonable notice of an indemnified claim and may control its defense and settlement, provided that we will not agree to a settlement imposing a nonmonetary obligation or admission on you without your consent, which will not be unreasonably withheld.

SECTION 23 – GOVERNING LAW AND VENUE

These Terms and any dispute arising from or relating to the Services or a purchase are governed by the laws of the State of California, without regard to conflict-of-law rules, except where federal law applies.

Subject to any rights you have under applicable consumer law, any court proceeding must be brought in the state courts located in Ventura County, California, or the United States District Court having jurisdiction over Ventura County, and each party consents to personal jurisdiction and venue in those courts.

These Terms do not require mandatory arbitration and do not waive any right to participate in a class action.

SECTION 24 – SEVERABILITY; WAIVER; ENTIRE AGREEMENT

If a provision of these Terms is held unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted and the unenforceable portion will be severed without affecting the remaining provisions.

Our failure to enforce a provision is not a waiver. These Terms and the policies and product-specific terms incorporated by reference constitute the entire agreement concerning the Services and purchases, except for any separate written agreement signed by Elevation PerTech.

If product-specific terms conflict with these general Terms, the product-specific terms control for that product. If an applicable Limited Warranty conflicts with these Terms regarding warranty coverage, the Limited Warranty controls.

SECTION 25 – ASSIGNMENT

You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or transfer of the Services, subject to applicable law.

SECTION 26 – CHANGES TO THESE TERMS

We may update these Terms by posting a revised version on this page and changing the effective date. If required by law, we will provide additional notice of material changes. Changes apply prospectively from their effective date and do not retroactively change the terms governing an order already accepted unless required by law or agreed by both parties.
